The U.S. District Court for the Middle District of Florida last week enforced valuable protections over hospitals’ Patient Safety Work Product-privileged documents pursuant to Patient Safety Quality Improvement Act of 2005 (PSQIA) – narrowly interpreting a prior Florida Supreme Court decision that had analyzed Florida’s Patient’s Right to Know Amendment (also referred to as Amendment 7), finding the federal law was not preempted.
