Jennifer Christianson focuses her practice on the health care industry. Her experience includes operations, regulatory compliance, civil litigation, and governmental and internal investigations. Before becoming a lawyer, Ms. Christianson worked in the healthcare industry in a variety of roles. Above all, she has a passion for healthcare and enjoys helping the patients her clients serve.
Hospitals, health systems, physician practices, health plans and other healthcare providers rely on Ms. Christianson for assistance with civil litigation as well as operational and regulatory issues ranging from Stark and Anti-Kickback compliance to federal and state privacy laws and regulations. She serves as a “go-to” counsel for one of the largest hospital chains in the country.
Regulatory Compliance Ms. Christianson provides advice regarding operational issues and regulatory guidance related to federal and state laws and regulations.
She routinely assists clients in implementing the requirements of the Stark Law, the Anti-Kickback Statute, the Emergency Medical Treatment & Labor Act (EMTALA), as well as similar state laws and regulations. This includes drafting, reviewing and analyzing their policies and procedures and providing guidance regarding their practices. She also reviews and drafts contracts and structures business arrangements.
Ms. Christianson conducts internal investigations and provides guidance regarding compliance with federal and state laws and regulations. She also handles all aspects of litigation related to these issues including individual claims as well as qui tam claims pursuant to federal and state false claims acts.
Licensure Ms. Christianson provides advice and guidance regarding all aspects of licensure for hospitals, health systems, physician practices, health plans and other healthcare providers.
She routinely assists clients in implementing the requirements of state licensure laws as well as The Joint Commission and the federal Conditions of Participation.
Quality, Risk Management & Peer Review Ms. Christianson provides advice and guidance regarding all aspects of her clients’ quality, risk management and peer review activities. She drafts and revises medical staff bylaws, rules and regulations, and policies and procedures. She provides guidance regarding operational issues and conducts internal investigations.
Ms. Christianson handles all aspects of credentialing and peer review of healthcare providers, advising onfederal and state licensure requirements and assisting clients with peer review and credentialing activities, proceedings and hearings. She also represents healthcare providers in relation to investigations and proceedings before state regulatory agencies.
In addition, she provides guidance regarding confidentiality and immunity for peer review, credentialing, quality and risk management activities. She regularly provides advice regarding The Healthcare Quality Improvement Act of 1986 (“HCQIA”), Patient Safety and Quality Improvement Act of 2005, and similar state laws.
She handles civil litigation related to quality, risk management and peer review including litigation related to confidentiality and immunity under federal and state laws.
Privacy As part of her practice, Ms. Christianson provides advice regarding privacy and cybersecurity.
Ms. Christianson works with health care providers and their business associates to develop and implement privacy and cybersecurity policies and procedures. This includes drafting, reviewing, and analyzing their policies and procedures and providing guidance regarding their privacy practices.
In addition, she provides advice regarding operational issues and regulatory guidance related to federal and state privacy laws and regulations. She routinely assists clients in implementing the requirements of the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), The Health Information Technology for Economic and Clinical Health (“HITECH”) Act of 2009, and The Affordable Care Act of 2010 (“ACA”) as well as similar state laws and regulations.
She assisted in reviewing and drafting contracts and structuring business arrangements to address federal and state privacy laws and regulations. This includes drafting contracts with business associates as well as providing counsel regarding joint ventures and acquisitions.
She assists clients in investigating suspected data breaches and provides advice regarding federal and state reporting obligations. She also assists clients in pursuing indemnification from the business partners.
Finally, Ms. Christianson handles all aspects of litigation related to privacy including individual claims as well as class actions.
Civil Litigation Ms. Christianson assists healthcare clients facing commercial disputes. Her knowledge of the healthcare industry and understanding of federal and state laws and regulations allows her to resolve disputes efficiently.
She works collaboratively with clients to plan and implement dispute resolution strategies as part of their daily business practices to avoid the expense of civil litigation. However, she also handles all aspects of complex civil litigation including claims based on allegations of fraud, breach of contract, tortious inference, malicious prosecution, disputes as to business structures and relationships, non-competes, employment relationships, debt collection and intellectual property.
